These Terms and Conditions (“Terms”) govern your use of salmondx.com (the “Site”) and any text message program operated by Salmon Diagnostics (“Salmon Diagnostics,” “we,” “us,” or “our”). By using the Site or opting in to receive our messages, you agree to these Terms. If you do not agree, please do not use the Site.
1. About the Site
Salmon Diagnostics is developing male fertility diagnostics, including SpermFit™. The Site provides general information about our company, our science and our progress, and lets you join our waitlist or contact us.
2. Not medical advice
Content on the Site is for general information only. It is not medical advice, diagnosis or treatment, and it does not create a doctor-patient relationship. Examples on the Site, including sample Spermometer results, are illustrations only and are not predictions for any individual. Always talk with a qualified healthcare provider about your own health and fertility. If you think you have a medical emergency, call 911 or your local emergency number.
Products and services described on the Site may still be in development and may not be available in all locations. Information about availability, features and timing may change.
3. SMS / text messaging terms
Program description. When you provide your mobile number and opt in, Salmon Diagnostics will send you text messages related to your request, such as waitlist and early access updates, replies to your inquiries, appointment or service notifications, and customer care messages.
How you opt in. You opt in by entering your mobile number on a Salmon Diagnostics form and checking the box agreeing to receive text messages, or by otherwise giving us your express consent. Consent to receive text messages is not a condition of any purchase or service.

- Message and data rates may apply. Check with your mobile carrier for details about your plan.
- To opt out, reply STOP to any message at any time. You will receive one final message confirming you have been unsubscribed, and no further messages will be sent unless you opt in again.

- Carriers are not liable for delayed or undelivered messages.
- You agree to tell us if you change or deactivate the mobile number you gave us.
Privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy for details.
4. Acceptable use
You agree not to misuse the Site. That includes submitting false or misleading information, interfering with the Site’s security or operation, trying to gain unauthorized access to our systems, scraping or copying the Site by automated means, or using the Site for any unlawful purpose.
5. Intellectual property
The Site and its content, including text, graphics, logos, the Salmon Diagnostics and SpermFit™ names, and the Spermometer visuals, are owned by Salmon Diagnostics or its licensors and are protected by intellectual property laws. You may view and share Site pages for personal, non-commercial purposes. You may not copy, modify, distribute or create derivative works from Site content without our written permission.
6. Information you submit
Please do not send us confidential medical information through Site forms. If you send us feedback or ideas, you agree we may use them without obligation to you. Our use of personal information you submit is described in our Privacy Policy.
7. Third-party links
The Site may contain links to third-party websites. We do not control and are not responsible for their content or practices.
8. Disclaimer of warranties
The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free or secure.
9. Limitation of liability
To the fullest extent permitted by law, Salmon Diagnostics and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, arising from or related to your use of the Site or our messages. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless Salmon Diagnostics from claims, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or your violation of these Terms.
11. Governing law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of laws rules. Any dispute relating to these Terms or the Site will be brought in the state or federal courts located in Michigan, and you consent to their jurisdiction.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the effective date above. Your continued use of the Site after changes take effect means you accept the updated Terms.
